In 2020, The Gap, Inc. entered into a “Strategic Agreement” with Kanye West and his company, Yeezy Supply, Inc. for them to design and create products and merchandise to be sold by The Gap. In 2021, Gap rented a 57,000 square foot warehouse in downtown Los Angeles from Zohar Law Firm client Art City Center, LLC for the purposes of providing a “creative design space” for Kanye West, giving him and his employees full use and access of the space. During the next year, Kanye West and Yeezy Supply made numerous alterations and demolitions to the building without Art City’s approval, including the removal of all bathrooms, skylights (allowing rainwater to enter the building), windows, industrial roll up doors, lighting fixtures, and electrical/fire panels. At the end of the lease, Gap agreed to make repairs, but took nearly 7 months to do so, refusing to pay rent during the time of repair. The jury unanimously agreed that Gap breached the lease and awarded Art City damages totaling $1.297 million. Under the lease, Art City was also entitled to be reimbursed its attorney’s fees and costs – approximately $500,000 — in addition to the amount of the verdict.
